LA REGOLA: COSA PREVEDE LA LEGGE?

A seguito della legge costituzionale n.1 del 1999 (che introdusse, per le regioni ordinarie, l’elezione diretta dei presidenti di regione), la legge quadro dello Stato n. 165 del 2004 ha fissato alcuni “principi generali” cui le regioni sarebbero state vincolate nel rinnovare la propria legislazione elettorale.
Tra questi, vi è il principio della “non immediata rieleggibilità”, allo scadere del secondo mandato, del presidente della giunta regionale eletto a suffragio universale e diretto (in pratica, un “divieto di terzo mandato” consecutivo per i governatori).

Due sono i punti più “controversi” di tale normativa:
I- tale principio è “direttamente applicabile” (a prescindere dall’emanazione di una conforme legge regionale)?
II- inoltre, lo stesso deve intendersi “retroattivo” (nel novero dei mandati consecutivi, dunque, devono ricomprendersi anche quelli precedenti l’entrata in vigore della legge n. 165 del 2004)?
Pur essendo vero che il legislatore statale non si è espresso in maniera inequivoca, la risposta comunemente data dal mondo giuridico-accademico è, però, positiva ad entrambi i quesiti.

E’ vero, infatti, che la legge del 2004 rinvia, per la “disciplina di dettaglio”, alla legislazione regionale (che, colpevolmente, in alcune regioni, tra cui Lombardia ed Emilia Romagna, non è ancora stata emanata), ma i maggiori costituzionalisti si sono espressi in favore della “diretta applicabilità” del principio su esposto.
Se così non fosse, del resto, si otterrebbe il risultato paradossale:
- di vincolare le regioni “solerti” (nell’approvare una nuova legislazione regionale) a dare immediata applicazione alla legge dello Stato;
- e di premiare, di contro, le regioni “inadempienti” (lasciandole libere di violare apertamente un “principio fondamentale” sancito da una legge dello Stato)!

Gli esperti, inoltre, concordano nel sostenere la “retroattività” del divieto.
Per far scattare il “vincolo del doppio mandato”, quindi, occorre tenere conto:
- non solo dei mandati vigenti (o successivi) al momento dell’entrata in vigore della legge n. 165 del 2004;
- bensì anche di tutti quelli “immediatamente precedenti” all’entrata in vigore della legge.
